Last Will and Testament
Compliments of the State

First: I authorize a probate Judge to appoint anyone of his/her choosing to administer and distribute all property left by me.

Second: I authorize the sale or auction of all my assets to provide cash for paying all my debts, taxes, probate fees, administrative fees, attorney fees and any other expenses incurred in administering my estate.

Third: If I am survived by one child, my spouse will receive only one half of my separate property. If I am survived by two or more children, my spouse will receive only one-third of my separate property.

Fourth: I direct that the balance of my estate be given outright to my children. If any of my children are minors, their shares shall be held and managed by a guardian for their benefit. I forfeit my right to appoint the guardian and leave that appointment to the Probate Judge.

Fifth: When each of my minor children attain the age of 18, his/her share is to be paid to him/her outright at that time. No consideration shall be given to his/her financial or emotional maturity.

Sixth: In the event that my spouse does not survive me, his/her share shall be added to the children's shares created under articles Four and Five.

Seventh: If my spouse survives me, but I have no children, or none of my children survive me, I direct that my estate be distributed in the following manner:

  1. One half of my separate property to my spouse
  2. The balance to my parents, if living, otherwise to my brothers and sisters or their heirs.

Eighth: If I am not survived by my spouse, children or parents the Probate Court shall seek out my closest blood relatives and divide my estate among them equally.

Ninth: If no blood relatives can be located, I direct that all my property go to the State.

Tenth: I forfeit my right to appoint a guardian to raise my minor children and direct the Probate Judge to make that appointment without the benefit of knowing my wishes.


By accepting this last will and testament, I abdicate to the State my right to make any decisions concerning the disposition of my estate and concerning the protection of the interests of my spouse and children. There is no need for my signature or witnesses.
